Terms and Conditions (T&C)

Scope
These General Terms and Conditions (GTC) apply to all contracts and services that are concluded or provided between the customer and the company Schoch Wonders (hereinafter "Provider").

Conclusion of contract
The contract is concluded by means of offer and acceptance. An offer can be made in writing, verbally or by e-mail. Acceptance is by signing a written contract, verbal consent or written confirmation by email.

Scope of services
The scope of the services to be provided results from the respective offer, the order confirmation or the contract. Changes to the scope of services require the written consent of both parties.

Prices and terms of payment
The prices for the services offered result from the respective offer or contract. Payments are to be made in accordance with the agreed terms of payment. In the event of a delay in payment, the provider reserves the right to charge reminder fees and interest on arrears in accordance with the statutory provisions. In the event of a delay in payment, the following reminder levels will be applied:
- First reminder: No fees
- Second reminder: reminder fee of 30 CHF
- Third and last reminder: reminder fee of 60 CHF and sent as registered mail
After the third reminder, debt enforcement proceedings are initiated, in which an additional processing fee of CHF 120 and 10% interest on arrears are charged on the total amount.

Delivery and service provision
The provider undertakes to provide the agreed services in accordance with the contract and any agreed dates. In the event of delays, the provider will inform the customer immediately.

Liability
The provider's liability for damage caused by intent or gross negligence is unlimited. In the case of slight negligence, the provider is only liable for contract-typical and foreseeable damages. Liability for indirect damage and lost profit is excluded. The limitations of liability do not apply to damage resulting from injury to life, limb or health.

Warranty
The provider guarantees that the services provided meet the agreed requirements. Defects must be reported in writing by the customer immediately. The provider is entitled to make improvements. If the rectification fails, the customer has the right to demand a price reduction or withdrawal from the contract.

Copyright and Use Rights
The provider grants the customer the rights to use the services provided for the agreed purpose. A transfer of the rights of use to third parties requires the written consent of the provider.

Data protection
The provider undertakes to comply with the applicable data protection regulations and to treat the customer's personal data confidentially. Further information on data protection can be found in our data protection declaration.

Changes to the Terms and Conditions
The provider reserves the right to change these terms and conditions at any time. The changed terms and conditions apply to all new contracts and services. The customer will be informed about the changed terms and conditions. If the customer does not object to the changed terms and conditions within four weeks after receipt of the notification, the changed terms and conditions are deemed to have been accepted.

Final Provisions
Should individual provisions of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions. Instead of the ineffective provision, a regulation shall apply that comes closest to the economic purpose of the ineffective provision.

Jurisdiction and Applicable Law
Swiss law applies to all disputes arising from or in connection with these GTC or the services provided. The place of jurisdiction for all disputes is the registered office of the provider.
